Why this affidavit is used

This affidavit is used when a bank account holder dies and their legal heirs/nominees want to claim the money (savings, FD, deposits, etc.) lying in the account. It acts as a formal declaration by the spouse/heirs confirming:

  • The death of the account holder.
  • Relationship of heirs with the deceased.
  • That there are no other claimants beyond those listed.

When it is used

  •  To claim money from the deceased's bank account when there is no nominee registered.
  • If a nominee is registered but deceased, legal heirs need to claim.
  • For joint accounts where one holder has died and the balance has to be released to the surviving holder/heirs.
  • During the settlement of Fixed Deposits, Provident Fund, or Locker accounts.

Purpose

  • To give the bank a legal basis to release funds without facing disputes later.
  • To confirm that only rightful heirs are making the claim.
  • To prevent fraudulent claims or concealment of heirs.

FAQs

Q1. Is this affidavit alone enough to get the money?

Usually, No. The bank will also ask for:
- Death Certificate of the account holder.
- KYC documents of heirs (Aadhaar, PAN).
- Succession Certificate / Legal Heir Certificate (if required by bank).
- Indemnity bond (sometimes).

Q2. What if the deceased had nominated someone?

Then the nominee gets priority. This affidavit may still be asked to confirm there are no disputes from heirs.

Q3. What if there is a dispute among heirs?

The bank will not release money until a court order (Succession Certificate/Probate) is provided.

Q4. Who should make this affidavit?

Usually the widow/widower or legal heir(s) of the deceased. In case of multiple heirs, all may be asked to sign or give No Objection Certificates (NOCs).

Q5. Is notarisation required?

Yes, it must be sworn before a Notary Public or First-Class Magistrate.
