Why this affidavit is used

This affidavit is required when someone applies for an EWS Certificate under the 10% reservation for Economically Weaker Sections (as per the Constitution (103rd Amendment) Act, 2019).
It serves as a self-declaration by the applicant stating:
- Their family income is within the prescribed limit (currently ₹8 lakh per annum).
- Their family does not own assets above the set thresholds (land, house, flat, or plot sizes).
- They belong to the General Category (not SC, ST, or OBC).
- They need the EWS Certificate for education, government jobs, or other benefits.

When it is used

- While applying to the Mamlatdar / Tehsildar / Revenue Department for an official EWS Certificate.
- At the time of admissions under the EWS quota in schools, colleges, or universities.
- For government recruitment exams and jobs where the EWS quota is applicable.
- For reservation benefits in public employment, scholarships, or other welfare schemes.

Purpose

- To formally declare economic and social eligibility for the EWS category.
- To provide a supporting legal document for getting the official EWS Certificate.
- To hold the applicant legally accountable if false claims are made.

Q1. Who needs this affidavit?: Any General Category applicant (not SC/ST/OBC) applying for EWS benefits.
Q2. Is this affidavit enough to get an EWS Certificate?: No. This affidavit is only supporting proof. You must also attach proof of income, property details, Aadhaar, ration card, and family details.
Q3. Who issues the EWS Certificate?: The Mamlatdar, Tehsildar, or Sub-Divisional Magistrate (SDM) issues it based on this affidavit and documents.
Q4. What happens if someone lies in this affidavit?: If caught, the certificate can be cancelled, and the person may face criminal action under IPC/BNS for misrepresentation and cheating.
Q5. What is the income limit for EWS?: Currently, ₹8,00,000 per annum (family income from all sources).
Q6. What assets disqualify a person from EWS?: Owning:
- 5 acres of agricultural land or more
- Residential flat ≥ 1000 sq. ft.
- Residential plot ≥ 100 sq. yards in a municipality
- Residential plot ≥ 200 sq. yards in non-municipal areas

- 5 acres of agricultural land and above.

- Residential plots of 200 sq. yds and above in areas other than the notified municipalities.
I say that my family do not possess any of the above assets anywhere in India nor abroad.
